● US REGULATION — ACTIVE

TSCA inventory status, checked before you sign — not after a shipment is stuck at customs.

Every chemical swap that touches the US triggers a check against the EPA's TSCA Inventory: nearly 87,000 substances, tracked by regulatory flag. Michael's ARCO module runs this pre-screen automatically, in parallel with REACH, OFAC and CBAM.

Why It's Not Optional

The stakes of getting TSCA wrong

TSCA inventory
~86,900 substances

About 42,600 are active (EPA, July 2025). The rest are inactive and need a Notice of Activity before reactivation.

Update cycle
Biannual

EPA refreshes the inventory every January and July. A substance's status can change without your counterparty noticing.

Flag codes
S / T / E / F

Significant New Use Rules, test orders and Section 5 consent orders each carry their own compliance obligations.

A pre-screen, not a ruling. ARCO screens swaps against published regulatory and sanctions lists and gates the workflow on the result. It is not a legal determination, a regulatory filing, or a substitute for your compliance function's formal sign-off.

How ARCO Handles It

The TSCA pre-screen pipeline, automated

ARCO checks every commodity with a CAS number against the published EPA inventory and its regulatory flag codes before a swap can proceed.

01

Inventory status lookup

ARCO confirms that the substance is on the TSCA Inventory and active. An inactive entry needs reactivation first.

02

Regulatory flag check

ARCO screens for the flag codes attached to the substance. They are Significant New Use Rules (S), test orders (T), Section 5(e) consent orders (E) and Section 5(f) rules (F).

CACHE TTL: 24 HOURS
03

Pre-screen result recorded

ARCO records the result as a hashed compliance snapshot. It is valid for 72 hours. After that, the swap needs a new screen.

EXPIRY: 72 HOURS

What You'll See

Three possible outcomes, every time

CLEARED

Substance active on the TSCA Inventory, no unresolved flag codes. Swap proceeds through the lifecycle.

PENDING

A flag code that needs a compliance officer's review. Or a substance that EPA reclassified recently.

BLOCKED

Substance inactive with no Notice of Activity on file, or subject to an active Section 5 restriction.
